1. Eligibility
• The child enrolled in the Starter School challenge (the “Program”) must be at least eleven (11) years of age at the time of enrollment. In the event that the participant is younger than eleven (11) years of age, explicit approval from Starter School is required prior to enrollment.
2. Consent to Communications
• By enrolling in the Program, you hereby consent to receive communications from Starter School via various channels including, but not limited to, text message, email, voice calls, and video communications. These communications are intended to ensure timely attendance to classes, provide necessary support, and for promotional and marketing purposes.
• You acknowledge and agree that Starter School reserves the right to utilize these communications for any lawful purpose deemed appropriate by the institution.
3. Waiver and Release of Liability
• Starter School shall not be held liable for any issues, damages, or losses arising from the use of third-party tools and services required for participation in the Program.
• By enrolling in the Program, you hereby release, discharge, and hold harmless Starter School, its officers, directors, employees, agents, and affiliates from any and all claims, demands, and causes of action of every kind and nature, whether known or unknown, which you may have arising out of or in connection with your participation in the Program, including, without limitation, any incidental, consequential, or indirect damages.
4. Data Protection and Privacy
• Personal data collected in connection with the Program will be handled, stored, and protected in accordance with Starter School’s Privacy Policy, which complies with applicable data protection laws and regulations.
• Such data may be used for the administration of the Program, to provide support to participants, for promotional and marketing purposes, and for any other purposes deemed necessary by Starter School.

6. User Accounts
• You may need to create an account to use some parts of our Service. You must ensure that the information you provide at the time of creating the account is accurate and complete. You are solely responsible for maintaining the confidentiality of your account and password, and you agree to accept responsibility for all activities that occur under your account.
7. Parental Responsibility
• Parents or legal guardians enrolling their child in the Program acknowledge and agree that they are responsible for supervising their child’s online activities and ensuring compliance with all Program guidelines and rules.
• Starter School shall not be responsible or liable for any misconduct, misuse, or inappropriate behavior exhibited by the child participant while using internet tools and services as part of the Program.
8. Intellectual Property
• All content, materials, and resources provided by Starter School as part of the Program constitute the intellectual property of Starter School and are protected by applicable intellectual property laws. Such content may not be reproduced, distributed, transmitted, displayed, published, or otherwise used without the express written consent of Starter School.
• Any content created by participants during the course of the Program shall remain the property of the participant; however, by participating in the Program, participants grant Starter School a non-exclusive, royalty-free, perpetual, irrevocable license to use, reproduce, modify, adapt, publish, and display such content for promotional and marketing purposes without compensation.
9. Financial Terms
• Payment for the Program must be made in full at the time of enrollment. Starter School reserves the right to refuse or cancel enrollment in the event of non-payment or payment disputes.
• Refunds: Refunds are available within sixty (60) days of purchase, provided that the participant has not received the $20 gift card reward upon completion of the Program. Refunds will be granted for reasons including, but not limited to, a change of mind or dissatisfaction with the Program. Once the $20 gift card reward has been received by the participant upon completion of the Program, the participant is ineligible for a refund. This policy is in place due to the fact that the participant has been compensated for completing the challenge.
10. Dispute Resolution
• Any disputes arising out of or in connection with these Terms and Conditions or the Program shall be resolved through arbitration or mediation, as determined by Starter School. The parties agree to engage in good faith efforts to resolve any disputes prior to initiating any formal legal proceedings.
• In the event that arbitration or mediation is unsuccessful, any legal actions or proceedings arising out of or related to these Terms and Conditions shall be brought exclusively in the courts located in the State of Texas. The parties hereby consent to the jurisdiction of such courts and waive any objections to the venue or jurisdiction of such courts.
11. Governing Law
• These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes or claims arising out of or in connection with these Terms and Conditions or the Program shall be governed by the laws of the State of Texas.
12. Modifications
• Starter School reserves the right to modify these Terms of Service at any time and to notify you by posting an updated version of the Terms of Service on this website. You are responsible for periodically reviewing the Terms of Service.
13. Acceptance of Terms
• By enrolling in the Program, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. You further acknowledge and agree that these Terms and Conditions may be updated or modified by Starter School at any time, and any such changes will be effective upon posting on the Starter School website.
